The present general conditions of sale regulate commercial relations between:

HÜVERLAND and its online customers (hereinafter referred to as `The Customer´).

Prior to any transaction, the Client confirms that he has become aware of and expressly declares to accept the present general conditions by pressing the confirm button that accepts the `Hüverland Terms and Conditions`.


1) Particular conditions of sale

The Client confirms that he has taken note, at the time of placing the order, of the particular sales conditions listed on the screen (name, price, components, weight, quantity, color, product specifications, etc.) and expressly declares to accept them without reservation . The placing of the order and its confirmation by the Customer materialize its full and total acceptance of the particular conditions of sale, applicable exclusively to the order in question.

The particular Conditions of sale complement the present general conditions and prevail over these in everything that is not regulated in them.


2) Ordering

The Customer confirms the order by pressing `Add to cart´. The order consists of a summary of all items that the Customer confirms by clicking on the `I accept the terms and conditions of sale´ button to proceed with the checkout.


3) Order confirmation

HÜVERLAND confirms the acceptance of the order placed by the Customer through the following means: electronic mail.

The order will only be completed after receipt by the Customer and confirmation by HÜVERLAND.

All new orders will only be considered valid after payment by the Client of any amounts due to HÜVERLAND, referring to any previous orders.

Delivery of any order will only be made after settlement by the Customer of all amounts due to HÜVERLAND.


4) Delivery of orders and supply conditions

The place and date of delivery of the order are chosen by the Customer when placing the order. HÜVERLAND reserves the right to use any carrier at its convenience to deliver the products to the address indicated by the Customer.


5) Delivery time

The shipment of orders will be processed within a maximum period of 2 days after confirmation and payment of the order. Deliveries are made within the deadlines stipulated by the carrier and are dependent on the geographic location where delivery of the order is desired. (For more information on delivery times and prices see the table of `Prices and Shipping Conditions´).

If one of the items is not in stock when placing the order, the Customer will be promptly notified, confirming to HÜVERLAND the next available date or proposing a replacement item that is equivalent. The Customer has 3 days to indicate whether he intends to replace the item or wait for the stock to be replaced. At the end of this period without any response from the Customer, HÜVERLAND will proceed with the order without the missing product, which will be delivered after stock replenishment. Delivery is at the recipient´s risk.


6) Shipping costs and other delivery conditions

All products are subject to shipping costs unless they exceed the minimum amount stipulated for postage charges. When exceeding this amount, postage will be free, except shipping areas are not covered by this policy.

Upon receiving the order, the Customer will have to sign the delivery note presented by the carrier, in which he can make any comments that are convenient. By signing the Delivery Note, the Customer confirms that he has received the number of packages indicated. Any complaints about damaged or missing products should be submitted to the Customer Support Service, by email or by mail to HÜVERLAND, lda. , Rua das Lagomas, nº35, bloco C 1º Dto.- 3720-724 São Roque, Oliveira de Azeméis, Aveiro, Portugal, or by email: geral@huverland.com within a maximum of three days after receiving the Order (date in the Delivery Note).

The occurrence of a possible situation of force majeure, by way of example, accident, strike, administrative decision or stopping of transport, which may delay, prevent or exorbitant the execution of supply, constitutes, by express agreement, a suspension clause or termination of the obligations of the HÜVERLAND company, without the right to compensation to the Client if the event in question extends beyond the 15 days after the deadline for delivery of the Order. In this situation, the Client will be fully and automatically released from his contractual duties under this order.

The HÜVERLAND company will notify the Customer by any appropriate means and on the day of the occurrence, in order to allow him to release his order (s) freely by simply replying by mail or email after the notification he will have received.

In the event that it is not possible to deliver to the Customer for reasons directly attributable to the latter, the HÜVERLAND company reserves the possibility to invoice a fee of € 20 (taxes included) for preparation expenses.


7) Shipping partner

Deliveries will be made by a carrier chosen by HÜVERLAND, during normal business hours. Select the shipping address, so that someone can receive the products.


8) Prices and Payments

All prices quoted include VAT. The price invoiced to the Customer is the price indicated on the order confirmation sent by HÜVERLAND. The settlement of products and services will be made using the payment methods available on the website for better and greater customer convenience. These can be done through:

ATM reference; (Reference generated after order completion and sent to the customer´s email);
MBWAY; (Confirmation to the customer´s email confirming the transaction);
PAYPAL; (Confirmation via email after finalizing the payment transaction);
Bank transfer (IBAN: PT50 0007 0000 0051 3269 2932 3 - SWIFT / BIC: BESCPTPL); (Confirmed by email after payment);

For the proper functioning of these operations, the customer will be directed to a safe environment on the server of our service providers. The bank transfer of the customer´s account will be made in the currency selected at the time of the transaction, two (2) days after the acceptance of the order by HÜVERLAND. HÜVERLAND reserves the ownership of the material (s) until the full settlement of the price of the material (s) and services by the Customer.

The product (s) ordered (s) will be supplied in exchange for the respective settlement by the payment methods mentioned above;


9) Product sheet

The photographs illustrating the products are indicative only. The accompanying texts are the reproduction of the information that appears on the packaging or in the respective instructions for use. The differences between the photographs and the existing products are of little relevance and do not imply any change in the main specifications of the products. The color of products displayed on the online store may differ from the actual color of the product, unless the color is part of the Product specifications.


10) Warranty

The customer will benefit from the legal guarantee against defects or anomalies not detectable in the products sold. All of our products are designed and manufactured to a strict quality standard. However, this warranty does not cover any defects or anomalies resulting from mishandling, lack of maintenance or care that are contrary to our instructions for use. The Customer should refer to the instructions and recommendations found in the instructions for use provided with the product.


11) Exercising the Right of Free Resolution

The customer is entitled to terminate this contract within 15 calendar days, without the need to indicate any reason. (20 days for countries outside the European community). The withdrawal period expires 15 days (or 20 days for countries outside the European community), after the day on which the customer or a third party appointed by him, other than the carrier, acquires physical possession of the goods.

The exercise of the right of free resolution must be exercised unequivocally by letter or e-mail to HÜVERLAND, lda. , Rua das Lagomas, nº35, bloco C 1º Dto.- 3720-724 São Roque, Oliveira de Azeméis, Aveiro, Portugal, or by email: geral@huverland.com

For the period of free resolution to be respected, it is enough that your communication regarding the exercise of the right of free resolution is sent before the end of the term of resolution.


12) Effects of contract termination

In case of termination of this contract under the right provided for in the preceding clause, all payments made will be refunded, except shipping costs, without undue delay and, in any case, no later than 15 days from the date we were informed of your decision to terminate the contract. The refund can be made by the same payment method used to make the purchase or by another means to be agreed.

Regardless of the agreed method of payment, reimbursement will never, however, incur additional costs. The refund will only be made after receiving the returned goods. You must return the goods or deliver them to the following address:

Without undue delay and no later than 15 days from the day you informed us of the termination of the contract. The deadline is considered to be respected if the goods are returned before the end of the 15-day period.

The direct costs of returning the goods (shipping costs) are the Customer´s account.

The Client will be responsible for any loss of value of the goods, if this occurs due to manipulation that exceeds what is necessary to verify the nature, characteristics and functioning of the goods.

Only the return of the goods that are in the same condition when the product were shipped, will be accepted. If it is found that the product came with marks of use, abuse, or damaged, no refund of the value of the order in question will be made. If such a situation occurs, the customer will be notified by email with a document justifying the status of the product in question. If the customer wants the product again, he will have to bear the shipping costs.
